All sales are final, and we do not provide refunds except as required by applicable law or as otherwise specified in your service agreement.
Limitation of Liability
To the maximum extent permitted by applicable law, krivelanto.top d.o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of our services.
Our total liability for any claims arising out of or relating to these Terms or our services shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
We do not warrant that our services will be uninterrupted, error-free, or completely secure. Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Indemnification
You agree to indemnify, defend, and hold harmless krivelanto.top d.o.o., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with your use of our services, your violation of these Terms, or your violation of any rights of another party.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.
Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ljubljana, Slovenia. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.
Termination
Either party may terminate your access to our services at any time, with or without cause, by providing written notice to the other party. We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in any conduct that we determine, in our sole discretion, to be harmful to our business or other users.
Upon termination, your right to use our services will cease immediately. We may delete your account and all associated data, although we may retain certain information as required by law or for legitimate business purposes.
The provisions of these Terms that by their nature should survive termination shall remain in effect after termination, including but not limited to intellectual property rights, limitation of liability, indemnification, and governing law provisions.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
Entire Agreement
These Terms, together with our Privacy Policy and any service agreements you may enter into with us, constitute the entire agreement between you and krivelanto.top d.o.o. regarding your use of our services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
